Margaret's Will

 

The last will and testament of the late Margaret Haughery was files for probate in the honourable the civil district court for the parish of Orleans, Monday February 13th 1882 by Messrs. Thos. Gilmore & Sons, Attorneys

The contents of this document but add, if possible to our admiration of this great and good woman. Charitable in thought charitable in speech, charitable in deed, truly was this mother of the Orphans and Angel of charity, in human form and humble guise. True to her noble and liberal nature, this great hearted woman has included the orphans, the unfortunates, and the aged and suffering poor of all creeds and denominations in her munificent be-quests as the long list of asylums and charitable institutions named, will fully testify.

To relieve the suffering of all, Margaret ever considered her daily and hourly duty, and how wonderfully has she exemplified in her life how much good can lowly, when imbued, as she was a wonderful degree, with loving faith, hope and Charity.

Margaret has appointed her tried, and trusted and old time friends, Messrs Charles McCready and Nicholas Burke as her executors, and has she selected New Orleans three times over, as she could not possibly have made a better choice. They are truly the right men in the right place.

We herewith annex the will and commend its careful perusal to all our readers trusting that it may awaken in many a determined desire to imitate even to a limited extent the noble example of this saintly woman:

STATE OF LOUISIANA

PARISH OF ORLEANS

City of New Orleans

Be it known that on this day, the twelfth of the month of October in the year of our lord one thousand eight hundred and eighty one,

I William Joseph Castell, a notary public in and for the parish of Orleans, state of Louisiana duly commissioned and qualified, accompanied by Messrs. James J.  Woulfe, Joseph Magioni and John B Buchannan, all three residents of this city, of lawful age and competent witnesses herein, proceeded to the Hotel Dieu in this city, situate on common street, between Johnson and Bertrand streets, for the purpose or receiving and making the last will and testament of Mrs. Margaret Haughery, and in parlour No. one on the left hand side going in from common street, and fronting towards common street

We met said Margaret Haughery who declared that, considering the uncertainty of this mortal life, and being of sound mind and memory, and apparently well in body it is her wish and intention to make and publish these presents as containing her last will and testament. Which will and testament she dictated to me, notary, in presence and hearing of said three a forenamed witnesses, in the words form and manner following, to wit:

My name is Margaret Gaffney, I am the widow of Charles Haughery, I had one child, issue of our marriage, names Frances Haughery, who died when an infant. I am the daughter of William Gaffney and Margaret O’Rourke, late of Baltimore, Maryland, both of whom are dead. I have no forced heirs.

I give and bequeath unto Louise Catherine Jarbot the sum of five Thousand Dollars and my interest in the rent during her natural life of the stores adjoining the bakery property: being the same stores that were purchased by M. Haughery & Co. from John T Moore:

She paying the taxes, and keeping them in repairs and paying insurance on the same. I bequeath to her also all movable property connected with my private apartment’s, consisting of furniture, silverware, Wearing apparel, and all the movable appertaining thereto

 

I give and bequeath bequest unto Clotilde Prentiss the sum of One Thousand Dollars

I give and bequest unto the Little sisters of the Poor Three Thousand Dollars

I give and bequeath bequest unto the Little sisters of the god shepherd, of this city, Three Thousand Dollars

I give and bequeath bequest unto the Catholic Boys Orphan Asylum, Third District of this city, Three Thousand Dollars

I give and bequeath bequest unto Sr Alphonsus Convent of Mercy, for its Orphan Asylum, One Thousand Dollars

I give and bequeath bequest unto German Orphan Catholic Asylum, the sum of One Thousand Dollars

I give and bequeath bequest unto German Protestant Orphan Asylum, the sum of One Thousand Dollars

I give and bequeath unto German Orphan Catholic Asylum, the sum of One Thousand Dollars

I give and bequeath unto Seventh Street Protestant Orphan Asylum the sum of One Thousand Dollars

I give and bequest unto the German Protestant Orphan Asylum – One Thousand Dollars.

I give and bequest unto the Seventh Street Protestant Orphan Asylum the sum of One Thousand Dollars.

I give and bequest unto widows and Orphans ‘Jews’ Asylum the sum of One Thousand Dollars.

I hereby liberate, cancel and remit all amounts due me by the St. Elizabeth orphans Asylum in favour of said St. Elizabeth Orphan Asylum

 

I consider that I have about thirty thousand dollars invested as capital in the bakery establishment of M. Haughery & Co. and the residue and remainder of all I may die possessed of, in moveable and immovable, rights and credits,

I give, devise and bequest unto the St. Vincent de Paul Emmittsburg,  of Maryland, for the use and benefits of its St. Vincent infant Asylum corner of Race and magazine streets, in the city of new Orleans,

I hereby instituting said society of the Daughters of Charity of St. Vincent de Paul, Emmittsburg, State of Maryland, My Sole heir and Universal Legatee.

I hereby appoint my old friends Charles McCready and Nicholas Burke executors of this my last will and test and, without security and seizing of my estate, and hope they will accept the trust.

I hereby revoke all other wills or Codicils that I may have heretofore made hereby ratifying these presents as containing my last will and testament. This will has then been dictated to me, notary by the testatrix in presence and hearing of said three aforementioned witnesses and written by me notary as dictated, in presence and hearing of said three afore mentioned witnesses and afterwards read in a loud and audible voice by me notary, to the testatrix in presence and hearing of said three aforenamed witnesses, whereupon the said testatrix declared that she perfectly understood the same and persuaded there in presence and hearing of said three aforenamed witnesses.

Thus done and passed at one time without interruption or without turning aside to any other acts in said room, the day, month and year first above written in presence of said three aforenamed witnesses, who here unto sign their names, together with said testatrix and me, notary, after the reading of the whole.

And now, the undersigned notary, having requested the testatrix to write her name , she declared she could not write her name, that she never wrote her name, that she did not know how to write , but made her usual mark to stand for her signature.

The whole being dictated, written, read, mark made, signed and passed in presence and hearing of said three aforenamed witnesses.
